1. Agreement to Terms

By accessing and using the services provided by Gleam Voyage ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access our services.

2. Description of Services

Gleam Voyage provides guided trekking and wildlife viewing tours in the rainforests of Borneo, Malaysia. Our services include:

• Day trekking adventures
• Multi-day expedition packages
• Wildlife specialist tours
• Educational and cultural experiences
• Transportation and accommodation arrangements

3. Booking and Payment Terms

3.1 Reservations

• All bookings must be confirmed with a 30% deposit
• Full payment is due 14 days before tour departure
• Bookings are subject to availability and weather conditions
• Minimum group sizes may apply for certain tours

3.2 Pricing

• All prices are quoted in Malaysian Ringgit (RM)
• Prices are subject to change without notice
• Additional costs may apply for special dietary requirements or medical needs
• Group discounts available for parties of 6 or more

3.3 Payment Methods

We accept major credit cards, bank transfers, and cash payments. Payment processing fees may apply for credit card transactions.

4. Cancellation and Refund Policy

4.1 Cancellation by Customer

• More than 30 days before departure: Full refund minus 10% processing fee
• 15-30 days before departure: 50% refund
• 7-14 days before departure: 25% refund
• Less than 7 days before departure: No refund

4.2 Cancellation by Company

We reserve the right to cancel tours due to:

• Insufficient enrollment
• Weather conditions or natural disasters
• Government restrictions or safety concerns
• Force majeure events

In such cases, customers will receive a full refund or may reschedule for a future date.

5. Participant Requirements and Responsibilities

5.1 Age Requirements

• Minimum age for most tours is 12 years
• Participants under 18 must be accompanied by an adult
• Special arrangements may be available for families with younger children

5.2 Fitness and Health Requirements

• Participants must be in reasonable physical condition
• Medical conditions that may affect participation must be disclosed
• Participants with heart conditions, mobility issues, or other health concerns should consult a physician before booking
• Emergency contact information is required

5.3 Participant Conduct

Participants must:

• Follow all safety instructions provided by guides
• Respect local customs and environmental regulations
• Not engage in illegal activities or substance abuse
• Treat fellow participants, guides, and local communities with respect
• Comply with all applicable laws and regulations

6. Safety and Risk Acknowledgment

6.1 Inherent Risks

Participants acknowledge that jungle trekking involves inherent risks including but not limited to:

• Injury from falls, wildlife encounters, or environmental hazards
• Exposure to tropical diseases and insects
• Weather-related dangers
• Remote location with limited medical facilities

6.2 Safety Measures

We maintain comprehensive safety protocols including:

• Certified and experienced guides
• First aid equipment and training
• Emergency communication devices
• Regular safety briefings and equipment checks

6.3 Insurance

Participants are strongly advised to obtain comprehensive travel and medical insurance. Gleam Voyage carries public liability insurance but participants are responsible for their own medical and travel insurance coverage.

7. Limitation of Liability

To the maximum extent permitted by law, Gleam Voyage's liability is limited to the amount paid for the tour. We are not liable for:

• Injuries, illness, or death resulting from participation
• Loss or damage to personal property
• Delays or changes due to weather or circumstances beyond our control
• Costs incurred due to evacuation or emergency medical treatment

8. Photography and Media Release

By participating in our tours, you grant Gleam Voyage permission to use photographs, videos, and testimonials for marketing purposes unless you specifically opt out in writing.

9. Environmental Responsibility

Participants agree to:

• Follow Leave No Trace principles
• Respect wildlife and natural habitats
• Not remove or damage flora, fauna, or geological features
• Properly dispose of all waste
• Support local conservation efforts

10. Intellectual Property

All content on our website, including text, graphics, logos, and images, is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

11. Privacy and Data Protection

Your personal information is collected and processed according to our Privacy Policy. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

12. Force Majeure

We are not liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, war, terrorism, or pandemic.

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of Malaysia, specifically the laws of the state of Sabah.

13.2 Dispute Process

Any disputes will first be addressed through good faith negotiations. If resolution cannot be reached, disputes will be resolved through binding arbitration in Kota Kinabalu, Sabah, Malaysia.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on our website with an updated effective date. Continued use of our services after changes constitutes acceptance of the new Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
